Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the standards of conduct and content that apply to all users of OhTrivia, including registered Hosts, invited users, and game Players. This AUP is incorporated by reference into our Terms of Service. Violation of this AUP constitutes a violation of the Terms of Service and may result in immediate account suspension or termination, content removal, and referral to law enforcement.
1. Child Sexual Abuse Material (CSAM) — Zero Tolerance
OhTrivia maintains an absolute zero-tolerance policy for child sexual abuse material (CSAM) and any content that sexually exploits, endangers, grooms, or harms minors.
The following are strictly prohibited:
- Any image, video, text, audio, or any other material that depicts, describes, or facilitates the sexual exploitation of any person under the age of 18, contrary to section 163.1 of the Criminal Code of Canada;
- Content that groomes, lures, solicits, or attempts to engage minors in sexual activity, contrary to section 172.1 of the Criminal Code of Canada;
- Any link to, reference to, or promotion of websites, communities, or material containing CSAM.
Mandatory Reporting Obligation: OhTrivia is legally and morally obligated to report any discovered CSAM to the Canadian Centre for Child Protection (cybertip.ca) and to cooperate with law enforcement. We will preserve all relevant evidence and user data to assist in investigations. Perpetrators will be reported to the appropriate law enforcement agencies without notice.
If you discover or suspect CSAM on OhTrivia, report it immediately using our reporting mechanism in-app or by emailing abuse@ohtrivia.com. You may also report directly to cybertip.ca.
2. Terrorism and Violent Extremism
The following are strictly prohibited:
- Any content that promotes, glorifies, facilitates, or recruits for terrorism or terrorist acts, as defined under Part II.1 of the Criminal Code of Canada (sections 83.01–83.33);
- Content that promotes or facilitates participation in any organisation designated as a terrorist entity by the Government of Canada or under applicable international law;
- Content that incites others to commit acts of violence, mass harm, or genocide;
- Fundraising or financing for terrorist organisations or activities.
OhTrivia will report credible threats or evidence of terrorist activity to the Royal Canadian Mounted Police (RCMP) and other relevant authorities, and will cooperate fully with any related investigations. Such content will be removed immediately upon discovery.
3. Hate Speech and Discrimination
The following are strictly prohibited:
- Content that advocates or promotes genocide or hatred against an identifiable group based on race, national or ethnic origin, colour, religion, sex, age, disability, sexual orientation, or gender identity or expression, contrary to sections 318–320 of the Criminal Code of Canada;
- Trivia content, game titles, or usernames that contain racial, ethnic, religious, or other slurs, or that are designed to demean, dehumanise, or harass individuals or groups on the basis of any protected characteristic under the Canadian Human Rights Act or the Ontario Human Rights Code;
- Content that denies or trivialises established historical atrocities such as the Holocaust, in a manner intended to promote hatred.
4. Harassment, Bullying, and Threats
The following are strictly prohibited:
- Repeated, targeted harassment, bullying, or intimidation of any individual or group;
- Threats of violence or harm against any person or group, contrary to section 264.1 of the Criminal Code of Canada;
- Publishing or distributing non-consensual intimate images (NCII) of any person, contrary to section 162.1 of the Criminal Code of Canada;
- Cyberstalking, doxxing (publishing private personal information to facilitate harm), or any conduct intended to cause fear, distress, or reputational damage to another person.
5. Illegal Content and Activity
The following are strictly prohibited:
- Any content that is illegal under federal, provincial, or applicable international law, including but not limited to content that violates the Criminal Code of Canada, the Copyright Act (R.S.C., 1985, c. C-42), the Competition Act (R.S.C., 1985, c. C-34), or any other applicable statute;
- Uploading, distributing, or facilitating access to pirated software, unlicensed copyrighted material, or counterfeit goods;
- Facilitating or promoting the sale of illegal drugs, controlled substances, weapons, or any other product or service whose sale is prohibited by law;
- Identity fraud, phishing, or any other deceptive practice intended to obtain personal information or financial gain from users or third parties.
6. Platform Integrity and Security
The following are strictly prohibited:
- Attempting to gain unauthorised access to OhTrivia, its infrastructure, or the accounts of other users through hacking, credential stuffing, brute force, or any other means;
- Uploading or transmitting malware, ransomware, trojans, viruses, or any other malicious code intended to damage, disrupt, or gain unauthorised access to systems;
- Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against OhTrivia or any third party;
- Using automated bots, scrapers, or other tools to extract data from OhTrivia without express written permission;
- Manipulating game scores, leaderboards, or outcomes through unauthorised means.
7. Spam and Unsolicited Communications
The following are strictly prohibited:
- Sending unsolicited commercial electronic messages in violation of the Canada Anti-Spam Legislation (CASL, S.C. 2010, c. 23);
- Using OhTrivia to distribute spam, chain letters, pyramid schemes, or any other form of unsolicited bulk communication;
- Harvesting or collecting email addresses or other personal information from OhTrivia without the express consent of those individuals.
8. Trivia Content Standards
In addition to the prohibitions above, all trivia questions and game content created on OhTrivia must meet the following standards:
- Factual accuracy: Multiple-choice questions should have a clearly correct answer supported by verifiable facts. Deliberately false or misleading trivia content designed to deceive players is prohibited;
- Age-appropriate content: Content intended for minors must be suitable for the stated audience. Explicit sexual content, graphic violence, or other adult-only material must not be presented in contexts accessible to minors;
- No glorification of illegal activity: Trivia content must not celebrate, glorify, or provide instructions for criminal activity;
- Intellectual property: Do not use copyrighted material (images, text, logos) in trivia content without permission from the rights holder.
9. How to Report a Violation
If you encounter content that you believe violates this AUP or is illegal, please report it immediately:
- In-app: Use the report button available on any game or content item;
- Email: abuse@ohtrivia.com — for abuse, illegal content, or urgent safety concerns;
- CSAM reports: Report directly to cybertip.ca (Canadian Centre for Child Protection) or call 1-800-843-5678;
- Terrorist content or imminent threat: Contact local law enforcement (911) or the RCMP National Security Information Network at 1-800-420-5805.
We take all reports seriously. We will review reports promptly and take appropriate action, which may include content removal, account suspension, and referral to law enforcement. False reports made in bad faith may themselves result in account action.
10. Enforcement
OhTrivia reserves the right, but not the obligation, to monitor content on the platform. Upon discovering or receiving a credible report of a violation, we may take any or all of the following actions, at our sole discretion:
- Issue a warning;
- Remove or disable access to the offending content;
- Suspend or permanently terminate the offending account without notice or refund;
- Preserve and disclose user data (including IP addresses) to law enforcement authorities as required by law or legal process;
- Report the conduct and any relevant evidence to the appropriate Canadian law enforcement authority, including the RCMP, local police, or the Canadian Centre for Child Protection.
No liability for enforcement decisions: OhTrivia shall not be liable to you or any third party for any enforcement action taken in good faith under this AUP, including account suspension, content removal, or reporting to law enforcement.
